FALSE REPORTS:  MOVING BEYOND THE ISSUE TO SUCCESSFULLY INVESTIGATE AND PROSECUTE NON-STRANGER SEXUAL ASSAULT – Joanne Archambault

After literally decades of feminist lobbying and demands for better treatment of rape victims, many police agencies across America are still stuck in a 1950s-era view of sexual assault. There are huge differences in the estimates given for the rate of false reporting of sexual assault. Studies and surveys range from 0% to 98%.

 

SELECTING A JURY AND OPENING STATEMENTS, PARTS 1, 2 - Paul DerOhannesian II

The dynamics of jury decision making will be outlined together with the role of theme in selecting a jury.  Understanding juror bias together with fundamental areas of jury questioning in child exploitation cases will be presented.  Strategies for incorporating storytelling techniques into opening statement will be presented.

CLOSING ARGUMENTS AND MEETING COMMON DEFENSES, PARTS 1, 2 – Jeff Brickman

These presentations will provide the attendees with a practical and common sense approach to recognizing and effectively diffusing commonly used defenses.  Seminar participants will also be provided with a easy to understand roadmap to preparing and delivering closing arguments in child abuse cases.  This track would be beneficial to prosecutors, investigators, and other witnesses in the criminal justice system. 

 

HEARSAY IN CHILD ABUSE, DOMESTIC VIOLENCE, AND ELDER ABUSE LITIGATION. BASIC PRINCIPLES AND RECENT CASES – John E.B. Myers

Addressing the use of hearsay evidence to prove child, domestic, and elder abuse. Topics include basic principles of hearsay. Exceptions to the hearsay rule. Impact of Crawford on use of hearsay. Recent cases from state and federal courts.
